Ltd. and its affiliates (&#8220;<strong>Virtuos<\/strong>&#8220;, &#8220;<strong>we<\/strong>&#8220;, &#8220;<strong>us<\/strong>&#8221; or &#8220;<strong>our<\/strong>&#8220;) use your personal data in connection with your application for employment with us.<\/p><p>It also describes your data protection rights, including a right to object to some of the processing which Virtuos carries out. More information about your rights, and how to exercise them, is set out in the &#8220;Your choices and rights&#8221; section.<\/p><p>We also may provide you with additional information when we collect personal data, where we feel it would be helpful to provide relevant and timely information.<\/p><p><strong>2. What categories of personal data we collect<\/strong><\/p><p>The categories of personal data we collect will vary by the country and nature of the role for which you will be considered. These may include:<\/p><ul style=\"margin-bottom: 30px;\"><li><strong>Personal identification, communication and right to work information:<\/strong> your name, home address, phone number; email address; age, date of birth, place of birth, gender, marital status, national identification number\/passport number, country of residence and nationality, immigration status, information about your entitlement to work, tax number and social security details;<\/li><li><strong>Application-related information:<\/strong> curriculum vitae (CV), cover letter, employment history, education history, qualifications and skills, reference contact information, position preferences, willingness to relocate, details of family members and dependents, desired salary, interests and aspirations, background screening information if relevant and bank account information if we re-imburse expenses; and<\/li><li><strong>Sensitive information:<\/strong> for example, information about your health and disabilities where we need to make any reasonable adjustments; equal opportunities monitoring information, including information about your ethnic origin, health and religion or belief; and information on committed or alleged offences and criminal conviction and proceedings insofar permitted by law.<\/li><\/ul><p>We collect most of this information from you directly. For example, data is collected through your CV; from correspondence with you; or through interviews, meetings or other assessments. We also collect some information about you from other people (e.g. recruiters, referrals), your referees or organisations (e.g. job listing platforms or from LinkedIn if you choose to connect us with your LinkedIn profile; where applicable, we also collect data from local authorities, publicly available sources, third-party background screening providers, credit reporting agencies and\/or regulatory authorities during the pre-employment screening process.<\/p><p><strong>3. Why we collect, use and store this personal data<\/strong><\/p><p>In certain jurisdictions, we have to have a legal basis to process your data. We explain each of these legal bases below. We also set out the purposes for which we process your data. For each purpose, we explain the lawful basis for that processing, the processing operations that we carry out and the categories of data that we process.<\/p><p><strong><em>Legal basis<\/em><\/strong><\/p><p><strong>Consent<\/strong> \u2013 sometimes we ask for your consent to use your data.<\/p><p><b>Legitimate interest<\/b> \u2013 we can process your data when this is necessary for us to achieve a business purpose, or where this is necessary for someone else to achieve their purpose. We explain below what interests we, or others, are trying to achieve when we process your data. Where we process personal data on the basis of a legitimate interest, then \u2013 as required by data protection law \u2013 we have carried out a balancing test to document our interests, to consider what the impact of the processing will be on individuals and to determine whether individuals\u2019 interests outweigh our interests in the processing taking place. We store, and where needed, update, your personal information to make informed decisions on recruitment and assess your suitability for the role, to communicate with you about your application, to respond to your inquiries and schedule interviews, and to reimburse you for any agreed expenses incurred in the application process.<\/p><p>To do this we use your personal identification, communication, right to work and application-related information. If we need to make adjustments for you during the recruitment process, we process special category data for this purpose.<\/p><p>This information will be shared with companies who host our Careers webpage and systems. We use Oracle Cloud Human Capital Management (\u201cOracle\u201d)\u2019s services to assist with our recruitment processes. If we re-imburse expenses, we share information with financial service providers.<\/p><p><b>Processing your application \u2013 (performance of the contract)<\/b><\/p><p>We collect and use your data to provide assistance, upon your request, with visa or work permit procurement, to prepare an offer letter, contract of service or contract for service or such other contract as will be entered into between you and us, and such other purposes as may be related to the foregoing.<\/p><p>To do this we use your personal identification, communication, right to work and application-related information<\/p><p>This information will be shared with companies who host our Careers webpage and systems. We use Oracle\u2019s services to assist with our recruitment processes.<\/p><p><b>Keeping in touch \u2013 (consent)<\/b><\/p><p>With your consent, we use your data to contact you about future career opportunities at Virtuos. This includes storing your data and keeping it up to date and using it to contact you.<\/p><p>We use your personal identification and communication information and application-related information for this.<\/p><p>This information will be shared with companies who host our Careers webpage and systems. We use Oracle\u2019s services to assist with our recruitment processes.<\/p><p><b>Improving our recruitment process \u2013 (legitimate interests)<\/b><\/p><p>We have an interest in improving our application and recruitment processes. To achieve this, we compile statistics regarding Virtuos employment opportunities, analyse your data and compare it to past recruitment processes.<\/p><p>We use your personal identification and communication information and application-related information for this purpose.<\/p><p>This information will be shared with companies who host our Careers webpage and systems. We use Oracle\u2019s services to assist with our recruitment processes.<\/p><p><b>Verifying information \u2013 (legitimate interests)<\/b><\/p><p>We have an interest in carrying out appropriate checks to verify the information provided by candidates. We verify the details you have supplied and, where applicable, conduct pre-employment background checks.<\/p><p>We use your personal identification information, communication related information, and application related information for this.<\/p><p>This information will be shared with companies who host our Careers webpage and systems and with background screening companies. We use Oracle\u2019s services to assist with our recruitment processes.<\/p><p>Where we check references or previous employment and education, we disclose the fact that you have applied to us to educational institutions and to previous employers.<\/p><p><b>Business interests \u2013 (legitimate interests)<\/b><\/p><p>We have an interest in protecting our business interests and legal rights, including, use in connection with legal claims, compliance, regulatory, auditing, investigative and disciplinary purposes and ethics and compliance reporting requirements.<\/p><p>We also have an interest in analysing and monitoring the diversity of the workforce in accordance with applicable laws including, for example, compliance with equal opportunity employment laws.<\/p><p>To do this, we store, use and may transmit your personal identification and communication information, application-related information and sensitive information.<\/p><p>This information will be shared with companies who host our Careers webpage and systems. We use Oracle\u2019s services to assist with our recruitment processes. We share information with legal and other advisers if there are investigations or potential claims.<\/p><p><b>Compliance with law \u2013 (legal obligation)<\/b><\/p><p>We use your data to comply with legal, regulatory and other requirements under applicable laws by analysing and possibly transmitting your personal information.<\/p><p>To do this we use your personal identification and communication information, and application- related information.<\/p><p>We also assess your fitness and propriety in connection your engagement in a controlled function, where applicable, by analysing your data. More information about verification and background checks<\/strong><\/p><p><span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, 'Helvetica Neue', Arial, 'Noto Sans', sans-serif, 'Apple Color Emoji', 'Segoe UI Emoji', 'Segoe UI Symbol', 'Noto Color Emoji';\">For certain positions, it will be necessary for us to verify the details you have supplied (for example, in relation to your identity, employment history, academic qualification and professional credentials) and to conduct pre-employment background checks (for example, in relation to previous criminal convictions or financial standing). The level of checks will depend on your role, in particular whether you will occupy a regulated role, and will be conducted at as late a stage as is practicable in the recruitment process and often only after you have been selected for the position. If your application is successful, we will provide further information about the checks involved and will obtain any necessary consent prior to completing such checks.<\/span><\/p><p><strong>5. How we share your personal data<\/strong><\/p><p>Personal data will primarily be processed by employees in our Human Resources, IT and finance, and facilities departments.<\/p><p>Your personal data will be shared with companies providing services, such as technology services including hosting, maintenance, administration and analysis, as well as other agencies, under contract to Virtuos as part of the recruitment process.<\/p><p>When we share your data with these companies, we have explained this according to each purpose under section 3.Your personal data also will be shared with government authorities and\/or law enforcement officials if mandated by law or if required for the protection of our legitimate interests in compliance with applicable laws.<\/p><p><span style=\"background-color: transparent;\">In the event that a Virtuos business is sold or integrated with another business, your details may be disclosed to our advisers and any prospective purchaser&#8217;s adviser and will be passed to the new owners of the business.<\/span><\/p><p><strong>6. Where we transfer your personal data<\/strong><\/p><p>Virtuos operates globally, which means your information may be stored and processed outside of the country or region where it was originally collected.As a Singaporean headquartered company, most of our IT systems are hosted in Singapore and all of the information listed in section 2 above is hosted in Singapore.<\/p><p>Where your personal data is to be transferred out of a country (e.g., Singapore), we will comply with the applicable privacy laws (e.g., Singapore\u2019s Personal Data Protection Act (the \u201c<b>PDPA<\/b>\u201d)) in doing so.<\/p><p><span style=\"background-color: transparent;\">In this regard, this includes us obtaining your consent unless an exception under applicable law applies, and taking appropriate steps to ascertain that the foreign recipient organisation of the personal data is bound by legally enforceable obligations to provide to the transferred personal data a standard of protection that is at least comparable to the protection under the applicable law (e.g., the PDPA). <\/span><\/p><p><span style=\"background-color: transparent;\">This may include us entering into an appropriate contract\/legal instrument with the foreign recipient organisation dealing with the personal data transfer or permitting the personal data transfer without such a contract if the applicable law permits us to.<\/span><\/p><p><span style=\"background-color: transparent;\">Where personal information of EU data subjects is transferred outside the EEA, and where this is to an affiliate or vendor in a country that is not subject to an adequacy decision by a relevant body such as the European Commission (<a href=\"https:\/\/commission.europa.eu\/law\/law-topic\/data-protection\/international-dimension-data-protection\/adequacy-decisions_en#adequacy-decisions-latest\" target=\"_blank\" rel=\"noopener\">read more here<\/a>), data is adequately protected by approved standard contractual clauses such as those approved by the European Commission (<a href=\"https:\/\/commission.europa.eu\/law\/law-topic\/data-protection\/international-dimension-data-protection\/standard-contractual-clauses-scc_en\" target=\"_blank\" rel=\"noopener\">read more here<\/a>) or a vendor&#8217;s Binding Corporate Rules (<a href=\"https:\/\/commission.europa.eu\/law\/law-topic\/data-protection\/international-dimension-data-protection\/binding-corporate-rules-bcr_en\" target=\"_blank\" rel=\"noopener\">read more here<\/a>).<\/span><\/p><p><span style=\"background-color: transparent;\">A copy of the relevant mechanism can be obtained for your review on request by using the contact details below.<\/span><\/p><p><strong>7. Your choices and rights<\/strong><\/p><p>In certain jurisdictions, you have the right to <b>ask Virtuos for a copy<\/b> of your personal data; to <b>correct, delete<\/b> or <b>restrict<\/b> processing of your personal data; and to <b>obtain the personal data you provide in a structured, machine readable format<\/b>. In addition, you can <b>object to the processing<\/b> of your personal data in some circumstances (in particular, where we don\u2019t have to process the data to meet a contractual or other legal requirement). Where we have asked for your consent, you may <b>withdraw consent<\/b> at any time. If you ask to withdraw your consent to Virtuos processing your data, this will not affect any processing which has already taken place at that time.<\/p><p>These <b>rights may be limited<\/b>, for example if fulfilling your request would reveal personal data about another person, or if you ask us to delete information which we are required by law or have compelling legitimate interests to keep. If you have unresolved concerns, you have the <b>right to complain<\/b> to a data protection authority in the country that you reside in or, the country of your place of work or the country where the alleged infringement took place.<\/p><p><span style=\"background-color: transparent;\">In certain non-EU jurisdictions, we may also charge you a reasonable fee for the handling and processing of your requests in accordance with applicable laws and you will be notified in advance of such costs. To the extent permitted by applicable law, please note that we are not required to respond to or deal with your request unless you have agreed to pay the fee.<\/span><\/p><p><span style=\"background-color: transparent;\">Where we collect personal data to administer a contract with you or to comply with our legal obligations, this is mandatory and we will not be able to process your application without this information. In all other cases, provision of the requested personal data is optional.<\/span><\/p><p><strong>8. How long we retain your personal data<\/strong><\/p><p><b>If you are successful: <\/b>we will retain your personal data only for as long as we need it for Virtuos&#8217;s legitimate interest in accordance with applicable law, for the purposes of the recruitment process and, once this process is finished, for an appropriate period so as to be able to deal with any legal claims linked to the application process. Recruitment records for successful applicants are generally kept for 7 years, depending on your jurisdiction.After this period, we will take steps to delete your personal data or hold it in a form that no longer identifies you.
